Sapphire Bespoke Retreats, LLC Contract- By submitting a reservation, you are agreeing to the following terms and conditions. By using our website and becoming a guest at Sapphire Bespoke Retreats property, you agree to the terms and conditions in this Agreement.
CANCELLATION POLICY: See property listing and/or reservation confirmation for the specific cancellation policy. In the case of a Sapphire Bespoke Retreats, LLC cancellation, through no fault of the guest, the guest may be entitled to a refund of lodging for the unused nights less certain booking costs. Sapphire Bespoke Retreats, LLC's liability shall not exceed the total amount paid for the unused nights in the event of cancellation.
PAYMENT: Your payment of 1/4 of the grand total (or a minimum of $300) was paid at the time of booking. The remainder of the balance was paid 30 days prior to arrival. If you booked through Airbnb or another 3rd party site, they have collected your payments according to their payment terms & conditions.
TAXES & FEES: Sapphire Bespoke Retreats, LLC collects all state, county and local sales and lodging taxes required by the appropriate jurisdictions. In addition to required taxes, Sapphire Bespoke Retreats, LLC collects a damage waiver and service fee so we can provide a more secure booking experience coupled with guest support during your trip.
LONG-TERM RESERVATIONS: Reservations of 30 nights or more are considered long-term and have different requirements. Long-term reservations are subject to their own cancellation policies, payment policies and terms. All monies paid for long-term reservations are non-refundable at the time the payment is collected. No refunds will be offered for cancellations. One third of the total booking cost will be taken at the time of booking. The remaining balance will be divided into equal monthly payments so that the reservation is paid in full 30 days prior to guest arrival. Long-term reservations are not subject to local sales and lodging taxes. Sapphire Bespoke Retreats, LLC reserves the right to cancel long-term reservations within 72 hours of booking.
CHECK-IN AND CHECK-OUT: : Check-in time is 4pm, Check-out is 11am. Sapphire Bespoke Retreats, LLC is authorized to charge you $50/hr to remove your items to our check in center and charge you for an extra night if you stay past check out time unless arrangements for late checkout are Confirmed.
CHECK-OUT: You must vacate the property no later than 11am MT. Departure instructions must be followed to avoid additional charges, at the sole discretion of Sapphire Bespoke Retreats, LLC.
SPECIFIC PROPERTY BOOKED: You have booked a specific property. However, on extremely rare occasions, the specific property you booked may not be available due to circumstances beyond our control such as maintenance problems with the property booked, or a change of ownership or management of the property since you booked. In the event that the property you booked is not available, Sapphire Bespoke Retreats, LLC will attempt to place you into a similar or better property at the same price or offer you another property at a lower rate. If the replacement property offered is not acceptable to you for any reason, Sapphire Bespoke Retreats, LLC will cancel your reservation and refund your total amount paid. Sapphire Bespoke Retreats, LLC does not guarantee that a suitable property will be able to be found. If the property you have rented becomes un-occupiable before or during your stay (heat or refrigerator breaks for example), Sapphire Bespoke Retreats, LLC will also make our best effort to find you a similar or better place to move to and if unable to do so, refund the portion of your rent unused.
EARLY DEPARTURES: As reservations are carefully scheduled in advance, no refund will be given if a guest leaves prior to their reserved departure date, regardless of reason.
HOUSEKEEPING: Sapphire Bespoke Retreats, LLC units are SELF CATERING at no extra charge. That means that the unit will be clean when you arrive and will be cleaned after you leave and include fresh linen and towels when you arrive. During your stay, YOU are responsible for any cleaning including taking out the trash and washing the linens that Sapphire Bespoke Retreats, LLC provides if you choose to wash them. If you want additional towels or linens, Mid-stay cleans may be purchased for a separate charge.
DAMAGE, TRASH, & CLEANING: Any damage, excessive cleaning, excessive trash, incidental charges such as added housekeeping may result in additional charges, at the sole discretion of Sapphire Bespoke Retreats, LLC.
DAMAGE WAIVER:Your rental INCLUDES an accidental reported damage waiver fee up to a maximum of $2,500. Therefore, the cost to repair any ACCIDENTAL and REPORTED damage to the rented property including any missing or broken items up to a maximum of $2,500 will be covered at NO CHARGE to you AS LONG AS the damage is reported to a Sapphire Bespoke Retreats, LLC employee before you depart. Any damage we deem to be purposeful or negligent or damage not reported will be charged to your credit card. Please report any damage that you notice when you check-in to avoid getting charged for damage you didn't create.
SMOKING: Smoking is prohibited in the property at all times. Condo Associations restrict smoking on complex grounds and porches. Removal of smoke detectors is illegal and will result in charges. Violators are subject to a $500 fine in addition to applicable cleaning charges at the sole discretion of Sapphire Bespoke Retreats, LLC.
LOCK OUTS: After-hours lock-out service will incur a charge of $175 if guest is at fault.
LOST & FOUND: It is the responsibility of the guest to ensure all personal items are gathered at departure time. Any item left behind in the property that a guest would like returned will be subject to a $35 handling fee plus packaging and shipping costs. We cannot guarantee an item left behind by a guest will be found.
PARKING: Sapphire Bespoke Retreats, LLC will provide parking passes and/or parking guidelines including the maximum number of cars allowed. Sapphire Bespoke Retreats, LLC will NOT be held liable for ticketing and/or towing of guest vehicles. Guests exceeding the maximum number of cars will be asked to move additional cars or may be towed. Paid overnight parking is provided by the Town of Breckenridge north and south of town. No refunds or compensation will be paid to guests that ignore the parking restrictions outlined in the ad when the property was booked.
KEYS: All keys, keycards, remotes will be left in the unit on the kitchen counter prior to departure. Lost keys, keycards or remotes will incur a charge of $150.
PETS: Pets are prohibited in the property at all times (including Emotional Support Pets) unless it’s a designated pet-friendly property. Any evidence of pets discovered in or around the home will result in a $500 fine, plus charges for any damages sustained or extra cleaning required, at the sole discretion of Sapphire Bespoke Retreats, LLC.
DESIGNATED PET-FRIENDLY PROPERTIES: There is a mandatory and non-refundable fee for bringing along your pet(s). The number of pets may not exceed the maximum listed for the pet-friendly home. If you bring a pet, you WILL be charged for ALL extra damage and cleaning required. You must comply with any applicable local regulations. Pets must be leashed at all times when outside, and must not disturb the peace. Animal can not be aggressive to other people (for example, it must not jump on or bite at neighbors). If there is a complaint of any type you will have to move your pet to a kennel at your expense immediately. You must pick up pet’s waste and remove it from the home and grounds before you depart (do not leave animal waste in trash containers). If you bring a pet to this property but have not indicated and paid for it on your reservation, you will be subject to immediate eviction of your party without refund, and a minimum fee of $500/pet.
VEHICLES: Breckenridge is located in a high-alpine environment subject to extreme weather including snow and ice that may make roads and driveways impassable and dangerous. All guests are encouraged to use all-wheel or 4-wheel drive vehicles. Roads can be difficult to navigate and driveways may be steep. Sapphire Bespoke Retreats, LLC will not provide refunds to guests unable to reach or get out of their property or to guests needing rescue or towing.
HOT TUBS: Guest use of any hot tub or spa assumes all risks and liability. Guests are advised that there are potential dangers to children who are not carefully supervised, as well as any person using hot tub or spa too long or if a person has health risks, is intoxicated, using any kind of drugs or medication, or is pregnant. Guests are advised that the chemicals used in the servicing and maintenance of the hot tub can lead to skin and eye irritations, rashes, and other reactions especially in children. Guest agrees to waive any claim whatsoever against Sapphire Bespoke Retreats, LLC, it's owners, contractors, employees, principals, agents, and associated property owners accidents, illness, or injury arising from use of any hot tub or spa. Guest agrees that he/she is responsible and liable for any damages that occur to the hot tub or spa through their or their guest's misuse or negligence.
Should guest or guest's guests contaminate the water with any foreign substance by not abiding by the rules, guest agrees to an additional charge of $125.00 to cover the cost to drain, clean and refill the hot tub and remediate the contamination to the filtering system. Each hot tub is serviced prior to arrival and the chemical levels are checked and recorded.
UNFORESEEN ISSUES: Unforeseen and uncontrollable circumstances may occur during your stay including but not limited to, internet, TV, and utility outages, inclement weather, travel delays, limited availability of town services, the closing of common & home amenities (including hot tubs, pools, and fitness centers). Guests are not entitled to full or partial refunds for any unforeseen circumstances. Sapphire Bespoke Retreats, LLC as an entity and the reservations associated with a home are not part of or party to the sales contract for a home; in the event that a home is sold and future reservations are not accepted by the new homeowner, reservations are subject to cancellation or the reservation may be moved to another comparable Sapphire Bespoke Retreats, LLC Property.
VIOLATIONS: Any violations of this rental contract and/or Sapphire Bespoke Retreats, LLC policies may result in immediate removal from the property.
LIABILITY RELEASE: Sapphire Bespoke Retreats, LLC, it's owners, employees, contractors, principals, agents, and associated property homeowners, will be released and held harmless from any and all liability, claims, costs and expenses whatsoever arising out of or related to any loss, damage or injury that may occur while on the premises.
AGE & OCCUPANCY RESTRICTIONS: Guests must be at least 25 years old to rent a property from Sapphire Bespoke Retreats, LLC. At any time Sapphire Bespoke Retreats, LLC may request that the guest who reserved must provide a valid ID as proof of age. The person booking the property must be in the property for the entire duration of the guest stay. Maximum occupancy at any time is equal to the number of people the property sleeps in beds. No people beyond that number are allowed at any time. Exceeding this occupancy is grounds for immediate removal from the property without refund.
PARTIES: No house parties, weddings, receptions or events are allowed at any Sapphire Bespoke Retreats, LLC property without express written permission from Sapphire Bespoke Retreats, LLC and an Event Fee calculated at the discretion of Sapphire Bespoke Retreats, LLC is collected more than 30 days before your reservation date. If there is a party in the property (as further evidenced by a noise complaint, security report, or by excessive amounts of trash or destruction) the guest will be charged for a complete clean, replacement of damaged items and property, HOA fines, plus any additional charges necessary to return the home to its previous state, plus any applicable event fees. Such activities completely void the Damage Waiver.
TV: Guests are not entitled to nor should they expect access to Cable, Pay Per View, Netflix, HBO or any other premium channel. Guests may never call the 3rd party service to purchase or extend the provided service. Circumstances outside of Sapphire Bespoke Retreats, LLC control may result in service interruptions, outages, degradation or what the guest may consider less than satisfactory service to what they may be accustomed to. Sapphire Bespoke Retreats, LLC will not reimburse or refund any monies to the guest in the event of any of the above circumstances.
INTERNET: Most properties are WiFi enabled; this is a service paid by the homeowner and a benefit extended to the guest at no additional cost and provided by a local service provider. Sapphire Bespoke Retreats, LLC cannot guarantee reliable or consistent internet service. Circumstances outside of Sapphire Bespoke Retreats, LLC control may result in service interruptions, outages, degradation or what the guest may consider less than satisfactory service to what they may be accustomed to. Sapphire Bespoke Retreats, LLC will not reimburse or refund any monies to the guest in the event of any of the above circumstances. If a guest wants to ensure optimized and reliable service, Sapphire Bespoke Retreats, LLC recommends guests travel with their own air card.
PHONE: Guests understand that phones (land line or VoIP) may not be present in a property and should not be expected. Guests are encouraged to have mobile phones charged for communication in an emergency. Some properties have poor cellular coverage which is beyond Sapphire Bespoke Retreats, LLC control. Refunds and credits will not be provided to guests for slow or nonexistent service.
ELECTRICITY: Breckenridge is serviced by Xcel Power Company. Power interruptions and outages may occur at any time. Sapphire Bespoke Retreats, LLC cannot guarantee power, heat or electricity in the event of an Xcel power outage or interruption. Sapphire Bespoke Retreats, LLC will not reimburse or refund any monies to the guest in the event of any of the above circumstances.
WEATHER: Sapphire Bespoke Retreats, LLC will not refund guests for any weather-related issues including but not limited to road conditions, lack of snow, too much snow, or inability to get to the property due to weather or flight delays/cancellations; or issues resulting in weather conditions such as power outages, etc.
ENVIRONMENT & SNOW: Breckenridge is located in a high mountain alpine environment - some properties may be as high as 10,700 feet. Hydration is important to minimize impacts of altitude change. There is typically 10-20% humidity year-round. Summer temperatures may average 60-80 degrees with a low in the 40-50s. Properties in Breckenridge DO NOT have Air Conditioning (AC) fans are provided for guest comfort. Winter temperatures may vary widely from negative temperatures to 40-50 degrees. Most properties in Breckenridge have baseboard heaters which may take several hours to register heat changes.
SNOW AND ICE WILL EXIST ON ALL SURFACES DURING MOST OF THE YEAR. IT IS IMPOSSIBLE IN THE HIGH ALPINE ENVIRONMENT TO PROVIDE A SNOW AND ICE FREE ENVIRONMENT. SNOW AND ICE WILL EXIST ON ROADS, DRIVEWAYS, WALKWAYS, SIDEWALKS, ENTRANCEWAYS, DECKS, STAIRS, PATHS, PATIOS, ROOFS, ETC. TAKE CARE WHILE WALKING, ENTERING AND ACCESSING THE HOME, ENTERING VEHICLES, ETC. TO AVOID SLIPS AND FALL. BE CAUTIOUS OF ROOF OVERHANGS WHERE SNOW AND ICE BUILD UP AND MAY FALL OR SLIDE.
SNOW PLOWING: Breckenridge is NOT a snow and ice free environment. Winter storms can bring many conditions. Plowing is provided by the homeowner Nov 1 - April 30. Plowing of driveways will occur when a storm produces more than 4-6 in 24hrs. We cannot guarantee when roads or driveways will be plowed as that is determined by many factors including severity of the storm. You must have a vehicle capable of operating in severe winter conditions as plowing is not guaranteed.
COMMON-USE AREAS & HOAs: Condominiums and townhouses are managed by 3rd party Home Owners Associations (HOAs). These HOAs manage and control shared amenities which include but are not limited to outdoor grills, hot tubs, pool, fitness areas, parking structures and areas, picnic areas and landscaping. Be aware that during non-peak times amenities may be unavailable due to circumstances out of Sapphire Bespoke Retreats, LLC control such as building and amenity maintenance or closures. Also, even during peak times HOAs may need to make buildings and amenities unavailable for emergency maintenance and other reasons out of Sapphire Bespoke Retreats, LLC control. For no reason will Sapphire Bespoke Retreats, LLC provide a refund if amenities are unavailable due to HOA closures or maintenance. Sapphire Bespoke Retreats, LLC offers a 365 days a year and has no control over the availability of amenities controlled by HOAs or complexes; nor does Sapphire Bespoke Retreats, LLC have any obligation to disclose availability to guests. Sapphire Bespoke Retreats, LLC will not provide any refunds to guests for the unavailability of such services.
TOWN & RESORT SERVICES: Sapphire Bespoke Retreats, LLC operates within the town of Breckenridge which offers wonderful events, entertainment, restaurants, cultural activities and more. Breckenridge Ski Resort offers recreational activities including the availability of the Breck Connect Gondola, lifts, trails and Fun Park based on weather conditions and seasonal schedules. Sapphire Bespoke Retreats, LLC offers s 365 days a year and has no control over the availability of resort, town or county services and activities; nor does Sapphire Bespoke Retreats, LLC have any obligation to disclose availability to guests. Sapphire Bespoke Retreats, LLC will not provide any refunds to guests for the unavailability of such services.
ABUSIVE CONDUCT: Sapphire Bespoke Retreats, LLC does not tolerate abusive conduct towards any of our employees, guests, owner-partners or contractors. Abusive conduct means the intentional conduct that a reasonable person would find hostile or offensive. Abusive conduct may include the infliction of verbal abuse, such as the use of derogatory remarks, insults, and epithets; verbal or physical conduct that a reasonable person would find threatening, intimidating, or humiliating; bullying; or the gratuitous sabotage or undermining of a person's dignity. Every Sapphire Bespoke Retreats, LLC employee deserves respect and to work in an environment free of abusive conduct by guests. As a guest, we expect that you will treat our employees and contractors with respect and understanding and not engage in abusive behavior. Sapphire Bespoke Retreats, LLC reserves the right to immediately stop all contact with any guest who is engaging in abusive contact and to remove any guest that is abusive from any Sapphire Bespoke Retreats, LLC manage property. Refusal of any guest to vacate the property once properly notify as a result in abusive behavior will be considered trespassing and we will will notify local authorities.
OWNERSHIP of PROPERTY: The guest acknowledges that they do not own nor have any rights to the property. The guest may never alter the appearance or function of any part or contents of the property at any time (this includes but is not limited to paint, window coverings, furniture, appliances). Additionally, the guest may never employ directly or on the behalf of Sapphire Bespoke Retreats, LLC or the homeowner a 3rd party contractor or vendor to perform any work or services within or to the property (this includes but is not limited to hiring housekeepers, handymen, contacting internet or TV providers directly). The guest may not move any furniture or electronics at any time.
FOR SALE: Sapphire Bespoke Retreats, LLC provides short-term rental services to properties that may be For Sale. If a property is For Sale, and a potential buyer would like to view or tour the property during a guest stay Sapphire Bespoke Retreats, LLC will notify the guest prior to the showing. If a property is sold, reservations may be canceled and refunded, or the guest may be moved to another comparable Sapphire Bespoke Retreats, LLC property will be provided to the guest.
LIMITATION OF LIABILITY: Sapphire Bespoke Retreats, LLC assumes no liability for your stay in Colorado or the activities that you take part in while here. The limit of Sapphire Bespoke Retreats, LLC's liability is the total amount of compensation we have received for your home rental.
INDEMNIFICATION AND HOLD HARMLESS: You agree to indemnify and save harmless Owner and Sapphire Bespoke Retreats, LLC for any liabilities, theft, damage, cost or expense whatsoever (including but not limited to attorneys' fees) arising from or related to any claim or litigation which may arise out of or in connection with Your use and occupancy of Premises including but not limited to any claim or liability for personal injury, damage or theft of property or infringement of intellectual property rights (e.g., illegally downloading video, audio or text files via any internet service located at Premises) which is caused, made, incurred or sustained by You as a result of any cause, unless caused by the grossly negligent or willful act of Sapphire Bespoke Retreats, LLC or Owner. Neither Sapphire Bespoke Retreats, LLC or Owner are providing any other warranty of any kind, except as otherwise expressly provided herein, whether written or oral, statutory or contractual, express or implied, including, without limitation, THE WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OR USE, which are hereby expressly excluded. The terms "Sapphire Bespoke Retreats, LLC" and "Owner" as used in this Agreement shall include their heirs, successors in interest, assigns, employees, agents, and representatives where the context requires or permits. The terms Guest, You, and Your as used in this Agreement shall include Tenant's heirs, successors, assigns, guests, invitees, representatives and other persons on Premises during Your occupancy (without regard to whether such persons have authority under this Agreement to be upon the Premises), where the context requires or permits.
CAMERAS: For the protection of the home and Owner rights to continue to rent their home, be advised that some homes have outdoor cameras are in place to ensure compliance with Summit County, Town or HOA Short-Term Rental rules (parking compliance, noise violations, trash violations, etc.) and violations of terms and conditions will result in guest fines, ticketing or even eviction.
AUTHORIZATION FOR CHARGES: I hereby authorize Sapphire Bespoke Retreats, LLC to charge my credit card for any and all charges related to my rental that may include damage to the property, excessive cleaning or trash, unpaid fees and charges applicable to the rental. If I booked through a 3rd party, I agree that Sapphire Bespoke Retreats, LLC may pursue collections of monies due through the 3rd party and I agree that will comply with the policies and decisions of the 3rd party to award Sapphire Bespoke Retreats, LLC reimbursement of of any costs related to property damage, excessive cleaning or trash, unpaid fees and charges applicable to the rental. I further agree that I will not charge back said charges. I agree not to dispute charges made under this agreement.
ACKNOWLEDGEMENT:By accepting this reservation you acknowledge that you have read, and do hereby accept and will abide by the terms & conditions contained herein. This rental agreement may be changed at any time and without notice.
